How I can get security deposit back from my agent?

My house located in FL . I just evicted out tenant this month. I had security deposit from my agent. after evicted tenant , the tenant still owed me totally $3900, I asked my agent try to get the SD back , but agent said they need a court order or tenant agree with in paper writing since the tenant eviction. I am wondering what is landlord-tenant law provide security deposit by FL law? is there need a court order in this case? or file a small claim court? what is difference between a small claim court and court order? any comments shall be appreciated. HANNAH

The property manager has kept the deposit for himself. It is not right but that is what happens with property managers. You will need to take the property manager to small claims court to get the deposit. Even if you win in court you may still not receive the money. Property managers frequently steal from landlords. If the property manager had done his job you would also not be behind $3900 in rent.

Simple. File a suit in small claims against the PM for the SD. No, the tenant's agreement is not required for the PM to provide you with the SD. Small claims court is where you file for cases under $X,XXX.00 and a court order is the judgment or award granted by the small claims court after reviewing your case. Don't delay, sue this criminal PM and get him out of your business.
