Correct me if I'm wrong, but what I gathered from this is that their lease isn't up until October 31, but are looking for a place now. If they intend to break their current lease, you can't expect that they'll obey any lease that you enter into them with. Just food for thought.

When I pointed out that two months was along time out, they stated that breaking a lease would be expensive. My thought was to collect a full months rent as a non-refundable holding fee, making sure that they understand not to ask for it back under any circumstances. Maybe they could move in 2 weeks early, as it takes time to move. The leases would overlap by 15 days.

I told them not to mention lease breaking.
