Yes, I am aware of what the covenant implies, from what the LL states he hasn't done anything to breach that covenant yet.

Victims of harassment are not yet a protected class in California. Keep in mind they may be in the future. What you are refering to is the protection from retaliation, this is not the same thing as a protected class.

In California, victims of domestic abuse are allowed to break a lease. I'd this the protected class he is referring to?

    Domestic violence is also protected under the FHA and California Civil Rights law and can break the lease under certain conditions.

    The protected class is 'Sex' under the FHA statues which prohibit harassment in housing.

Several Laws protect tenants from harassment in California such as Fair Employment and Housing Act (FEHA), Ulrich Act, FHA, also many Cities have their own ordinances for discrimination against tenants.

Retaliation is where most landlords are caught violating the law.
