If you claim the son was an occupant, then the landlord cannot terminate the lease because one occupant has died. The lease continues under the Son.

The OP stated; The lease was with the Father. The Father is the 'tenant'. The Son was an 'occupant' under the lease.

If you claim the Son was a Tenant, then the lease is still in force till properly terminated.

If the Son is an Occupant, then the Son has no legal right to stay in the rental and may be asked to leave with proper notice.
