Absolutely. You had 30 days to get the accounting and deposit out. You blew the deadline. Not only did you fail to get the accounting out, but you failed to refund the deposit. In the tenant's eyes, you stole their deposit. In PA, and in most other places for that matter, that will get you spanked hard.
