In fact, in more states than not, that particular clause is usurped by state law which deals with allocation of costs in certain types of suits. That's one I would not have balked at removing -- but the larger picture of how many changes the prospect wanted would have made me decide not to take them. My lease and every clause in it exists to protect me from folks who have never owned a home and don't know how to act when they rent mine. Well-mannered folks who treat my house with respect don't run up against very many of the lease clauses. It's kind of like when a tenant asks you up front for a 5-day grace period for payment ... my though is, "why, are you already planning to pay late?" The fact is, if you act appropriately under the terms of the lease, you won't have problems.
