Wow...so if I am being stalked by some weirdo...I cannot get a restraining order unless I live with him? What a backward law!

Stalking is the only non-domestic application of a PO.

    Nonsense.

If I have a co-worker threatening my life, I assure you the court will aware a restraining order. Even when he isn't stalking me or living with me.

If my roommates boyfriend is coming round and threatening me, I will have no trouble getting a restraining order. Even when he isn't stalking me or living with me.

If the guy across the hall from me is threatening me, I will get a restraining order.

The court isn't stupid. The law certainly understands that a threat does not ONLY come from the person living with you or the stranger on the corner.

Maybe there's a difference between a restraining order and a protective order -- here's an excerpt from my county court's request for protective order form (note the language in the "persons not related" line):

      4. The Petitioner and additional parties are related to
the Defendant as follows: (check all that apply)
      □Married
      □Divorced
      □Parent & Child
      □Persons Related by Blood
      □Persons Related by Marriage
      □Present Spouse of an Ex-Spouse
      □Persons Living Same Household
      □Formerly Living Same Household
      □Biological Parents Same Child
□Persons in a Previous Dating Relationship
      □Persons in a Dating Relationship
      □Not Related
(Stalking requires filing police complaint, with copy
attached. No other relief is permitted by the Protection from
Domestic Abuse Act for non-related parties.)
