Her, in NY (Albany area): to rent to Section 8's T, your unit MUST pass an inspection by the Section 8 department.

It is not, in any way, an obligation for a LL to ask for the inspection, if LL does not want to have Section 8 Tenants.
In other words : nobody can force a LL to accept Section 8 T.
In your case, you should ask your T to leave and to find a Section 8 unit somewhere else. (certified letter; contact your attorney; keep all the documention)
