Did you see mold under the sink when you inspected for damages? Did you even inspect at all? Then you should have noticed the mold. Are you sure it's mold and not mildew?

So did the old tenant sue you because you failed to return the security deposit or what?

You hired a mold specialist for what? What was the result of the test? Did you are the handyman try cleaning the mold/mildew off before hiring a mold specialist?

"seems the MN courts believe that all landlords are criminals and the rights supposedly provided to you in your lease don't exist" Maybe the truth is the MN courts think you are some basket case for going overboard with this mold/mildew thing. That you lost your case because you failed to prove it.

So it looks as if you were in court because you failed to return the old tenants security deposit and were sued and lost or you filed suit against old tenant for an unfounded mold problem and lost. At least the old tenant was smart enough to have legal representation to fight such nonsense!

Getting out of the landlord business is not due to a little mold or mildew problem, but do to your poor business acumen dealing with problems.

I did do a quick inspection, but had limited time due to a family illness and new tenant moving in within 24 hours after old tenant moved out. I had planned to do a walkthrough with new tenant after she had a few days to settle in. The new tenant found the mold 2 days after moving in (before walkthrough), sent me photos 4 days after old tenant moved out, I did further inspection (5 days after old tenant moved out), called mold inspector who confirmed non-toxic mold. Mold inspector sent instructions on how to remediate, I gave instructions to handyman who did repairs. As I found the mold creeping through the wall to the mechanical room, cleaning with bleach would not have stopped the problem - the mold would have come back. I followed all rules regarding security deposit, held out the amount for damages and returned the rest. As I wrote before, tenant claimed she didn't know about the mold, yet took a picture of the car cover before moving so she planned to sue when I held out money for damages. She claimed a car cover kept outside 24/7 for a year was never wet, yet the cover instructions showed quite clearly that the cover will let moisture through if it isn't washed regularly, which she said she never did. The plumbing is only 14 years old (new construction then), and handyman saw no leaks, drips or moisture in the walls. Photos of the repairs and damage were taken and shown in court. Tenant stated she had saw no problems with laundry sink, washer, leaks or drips while there. Please read the entire post before making negative comments if you want to be taken seriously. Tenant sued because she claimed she didn't do the damage. She got free legal representation from state funds. I also had evidence that there was no damage or leaks ever in that area. As the law in MN is that landlords can't enter a premises without 24 hour notice, how am I supposed to go in to see the car cover when wet under the sink?
