disagree with the above. if October rent is not paid, go to the magistrate at 8:30 tomorrow morning and file against the tenant whose name is on the lease. you do not need any other names as the constable posts the property, doesn't serve a person. you are asking for possession of your property so it doesn't matter who does or doesn't reside there.

if you have a clause in your lease that states vehicles not registered with you can't be on the property, you're okay ... if not, wait for the eviction.

I also would be at the door (actually would have been there the first day I knew about him) talking to the guy. for all you know, the prior tenant may have collected rent from this guy and he thinks he's a legit tenant. he may be in the dark and doesn't know he can't stay.

you want your place back with no damages. don't start out antagonizing the guy before you know his side of the story
