Ex Wife wont move out - Landlord Forum thread 348848

Ex Wife wont move out by Anonymous (Texas) on October 20, 2016 @14:38

I have been divorced for 4 years, i was awarded the house. my ex wife moved out, 8 months later she moved in until she got back on her feet, free of rent. When i saw that she was not doing anything to better herself or her situation i asked her repeatably to move out. She refuses to move , i call the cops and they say this is a civil matter. She has damaged my clothes, pawned my items, harnessed my girlfriend, sent me threatening messages, etc. My kids let her in because the cops say she has a right to be there, even after i show them the divorce decree and the title of the house.
I filed an eviction to finally get her out, so now she wants a trial by Jury. What could she possibly want?
Is this just to buy time, i don't know what to do, this is delaying the process. can i lock her out? Can i shut off the lights? She is wanting me to give her a free car and more money. She was given a large amount of money when we divorced and a paid off car. She blew the money and no telling where the paid off car went.
She wont leave and i dont feel that i need to give her 1$ more.

this is not a landlord tenant issue. this is a family issue. if you two are into playing games, why don't you file contempt proceedings and take her back to family court. what grounds, I've got no idea except the judge would tell you both to knock it off for the sake of your kids.

Unfortunately, once you let her in and she refuses to move, you will have to evict her.

You cannot just lock her out and you cannot shut off utilities.

A trial by jury? For what?

If she's not obeying the divorce decree, then she's in contempt. Speak with the court.

And, as Nicole stated, this is not a landlord tenant issue regardless of how many times you downvote.

I agree with Anon. YOU are the one who screwed up here, by letting her back in to the house again, ( probably against the divorce decree's orders.) No, you cannot lock her out or shut off the lights. She could sue you for doing so, and have a VERY good chance of winning. Now YOU need to hire an attorney to do a formal eviction for you , and this time KEEP HER OUT FOREVER! We all learn from the school of hard knocks, and this time YOU are going to learn from it.

You must evict.
