Hi All,

In my previous post I was reading off, a lease pdf he had sent me in the beginning, and had assumed it was the same lease we had signed. The lease he had sent by email stated a guest cannot stay 7 consecutive days. After review of the lease we signed, it states that a guest can only stay 7 days out of a whole year...or we'll be charged $150/month.

Personally, I think this was pretty underhanded, but then again, its on me to read what I'm signing.

In my belief, this is pretty excessive. Excessive enough to be considered outrageous and unenforceable.

Am I right that he has no grounds to enforce a fee if a guest stays more than 7 days a year?

Could I argue that he has violated my right for "quiet enjoyment"? And that he cannot legally charge me a fee for the remainder of my lease if I were to guests that stayed more than 7 days?

I definitely understand, don't be an asshole, and just have my girlfriend move in, which is a non-issue, because she has her own place and we prefer our away time during the week as well.

I'm having a meeting with him tomorrow, I'd like to know what I could best use as my supporting argument. Thanks for any advice!

I feel you are just trying to figure out any way you can, to change the meaning of the word " guest " to fit YOUR particular situation. You're trying to twist the LLs wording of your lease, so that you don't have to pay extra money. Use some common sense here. If you went to a mall, and asked 1,000 people their definition of a "guest", what would 90% of them say ? In my mind, a guest is someone who may stay with you, ( your friends or relatives) for a weekend, over holidays, at spring break, or on their 1-2 week vacation. Or even if they are attending a special event in your town. The stay over is always short term, and usually the people are coming in from out of state, and you offer them a place to crash, to avoid hotel bills. Landlords have NO problem with those types of " guests". We LLs accommodate our own friends and relatives the same way. BUT YOU are trying to pass off your girlfriend( who probably lives in the same town as you do) as that type of a guest. DON'T DO IT ! Come clean with the LL, before he decides to take you court. Put your GF on the lease, pay the LL extra for her being there, and you and the GF can STILL have your same arrangement as you have now, with both of you keeping separate apartments. Remember, he is the LANDLORD/OWNER of the property. If you " p#ss " him off, no matter what happens during your lease, your LL will eventually give you notice that YOU will NOT be living there once your lease ends.
