So your question boils down to something like do you treat all adults applying for your rental as equals regardless of familial status? I know that's not what you were thinking, but I can envision an attorney in a fair housing claim saying things like that.

It's simple. Set policies for YOUR BUSINESS of renting apartment(s). Put them in writing, and follow them. It sounds like you have a "soft policy" of running credit and background checks. I'd firm it up. Personally I require credit and background checks on ALL adults on the lease. I require ALL adults occupying the premises to be tenants on the lease. I do not permit tenants that do not occupy the premises, with the noted exception of "reasonable accommodation" in buildings that FHA applies to.

So Must you? No. Should you. Yes.
