Yes, they can do it.

You are also in violation of State Law. FLorida requires the payment of a hotel tax for every night unless there is a minimum 6 month lease inplace.

Fix this quick. HOA can make those fines financially painful.

I have 4 condos in 2 different Associations. Sat on the board of governors at one of them in years past. They do have this power. Just comply

Just as aside.....

Most short term rentals write the lease for 6 months...and the only penality to the tenant is they lose their deposit. This way they rent to snow birds, and avoid the tax. They just point to the penality and the fact that the lease was broken
