Does your state law say that the rent isn't late until the 4th, or is that language in your lease?

If your lease states that the rent isn't late until the 4th, this means you're allowing a grace period, which your tenant has every right to use.

You can have it both ways. You either want the rent on the 1st, or you want the rent on the 4th. Get rid of the grace period at renewal time if you want it on the first.

Sorry, I meant to say you *can't* have it both ways. If you've put in a grace period, you can't be upset that tenants use it.
