Also, an afterthought here. What the lease says,......and what many judges will say often differs. Your lease may be legally correct, per the actual law,....but judges rule in their courtroom, at their pleasure and discretion.and their interpretation.

Most will indeed follow the """""if ya don't pay,....ya can't stay...."""" Philosophy regarding the base rent without penalties or late fees, but tenants do have the way of dancing LLs around in the courtroom.

In reality,... And generally in the courtroom, rents due on the first and received by the tenth are,...""on time"". Irrespective of the law or what the lease says.

The acceptance of partial rents does add another dimension which works both ways,......again at the judges discretion.
