Above all, you need to bring KNOWLEDGE to the court system. Do you know the eviction laws, and your LL/T laws by heart. When you accepted the $175 partial payment, did that acceptance void or delay your notice to quit?

Your first sentence in your post, along with the "Grrrr" at then, shows your are getting emotional about this. When you go to court, keep your "emotions" out of it. To you, this is strictly a business transaction. State only facts, and present letters/emails/texts only. You can state what was "said" by each party, but don't show any "emotions".

Use the words "Your Honor" several times in your testimony, and even if you lose, still say "Thank You, Your Honor" Get back to us on this forum on Oct.2, and let us know what happened.

I appreciate the advice, Garry. I certainly do get emotional about evictions. The last two I had, I simply had to remind myself continuously on the drive there "this is the cost of business - if you show emotion - you lose."

Ultimately, it's annoying that he's not paying, but it is what it is. Karma may get him eventually. And whether I am a Plaintiff, Defendant or a Witness, "Your Honor" is all I will ever call the judge. I was in court a few years ago and one of the parties kept calling the Judge "Mr". He was warned once, warned once more and then the Judge laid into him for about 5 minutes. You could hear a pin drop.

I wonder if the $175 partial payment would throw a wrench in things.

Rent was late for Aug & Sept.
Filed for eviction on Sept 16.
Rec'd $175 on Sept 18.

Any ideas...?
