I have a T who has not paid part of January and full Feb rent.
He is not responding calls or messages. I am not sure if I have to give him 3 day notice to start eviction process, I am confused if process will be after March 31, don’t know if I have to start with 3 day notice now or after March 31st.
I understand T can sign a form to avoid being evicted but this T has not given me this form.
Any advice?

It is unclear in Iowa as to if you can start the eviction paperwork now, or you have to wait til after the eviction moratorium in done. Right now, you cannot file any paperwork for Jan. rent. You can ONLY file for the CURRENT month that rent is unpaid. You have not actually lost Jan. rent, only the ability to EVICT for Jan. rent.

You can still total up any/all unpaid rent on your sec. dep. statement that you send to the T once they are out. I told you in an earlier post to ONLY file to get a person out, if they have violated OTHER terms of your lease, OR if they have not complied with your 30 day notice to move by March 31.

The form you are talking about, the T does not have to present that to you UNTIL you have actually filed for an eviction. My suggestion is that you should talk to an attorney that knows the eviction process and is up-to-date on the eviction moratorium. Even though it ends on March 31, President Biden could extend it farther. Stick with your 30 day notice to move if you want the T out asap. Do your paperwork for eviction in the first week in April, if the T doers not move by March 31.
