If the upstairs tenant has not paid you rent for months, and will not let you in, then just forget about that T. Do not try to get in, or contact him in any way. Treat that apartment as a vacancy, that you can't get to, to work on it for 6 months. The eviction moratorium is ending in a week ( July 1 ) Start your eviction of him on that date, for nonpayment of rent. If the T tries to contact you, don't answer him, except to say he must contact you in writing, or email form. ( that gives you a paper trail if you need to show a judge anything) Take NO phone calls, and DO NOT contact the T in person AT ALL. Take care of your downstairs tenant by spraying for bugs once per month, till you have the other T out, and you can get in to spray the upstairs, too. Your other T can be your "eyes and ears" as to whether the upper T has moved out, or not. If the upper T wants something (in writing or email form only), write or email back, that he will get what he wants as soon as ALL back rent is paid to you, in FULL.
