Month-to-Month Termination

I have a rental property and lease agreement with tenant is ended. I am considering this tenancy now month-to-month as lease agreement only said it ended in Feb and we did not renew the agreement. Can I now send a termination of tenancy and ask the tenant to leave within 60-days?
Tenant is currently late with rent (and continuously late with rent) and I also have issues with noise (duplex rental) and ready to "let them go" and neighbor issues. I don't know yet if I want to do a notice to quit because I am considering asking tenant to leave at this point and if she pays me, then this may stick me with having to do the eviction process?
Any advice.

You are correct. She is now on a M2M lease with you. If she is now late with May's rent, and you now give her a notice to pay that rent, and she pays you, you cannot evict her for non-payment of rent.
If you truly want her out, then yes,give her your 60 day notice to move out, ( by Aug. 1, 2023.) Just be prepared for her not to pay you ANY rent until you manage to evict her for staying past your Aug 1 deadline. That could be 6 months from now.
