We gave our NY tenant 90 day notice via phone and taped to door in July. He has been avoiding contact since then, but is paying. This is an apartment in our home and we want to use the apartment for family. He has been slowly destroying the apartment.

We have also sent notice via USPS but have not seen it come through via informed delivery. We believe the tenant is somehow intercepting the mail... he works at the local USPS and used to have the mailman put mail at his door. Since this process his mail has been coming through our slot. We recently sent certified letter... it came with electronic certification showing scribble for signature and address and said it was hand delivered to someone at residence, yet it was deliver through our mail slot by mailman (can see this on ring camera).

Not sure how else I can have proof of giving him notice at this point. NY is a big tenant rights.

I am assuming the most I can do at this point is go through an attorney? Does anyone have any advice?
