Tenant leased a commercial space that was a consignment shop. He took anything of value and left all the junk. Did not clean up anything. There are probably 4-6 large dumpsters required to throw out the mess. If there are nor personal items in the mess, can it all be throw out now or do we have to wait for a time period of abandonment (state of NH)? What is this time frame if so. Is small claims court our remedy and would it be the court be the one in the county that the property is located in?

If this was a true consignment shop, will you be tossing out things that your tenant did not own? First of all, take pics of everything just as they set. Then contact an attorney. You don't want someone coming in later, claiming things of value they had consigned, were stolen, or worse, YOU thru them out.

Once pics are taken, you may need to go thru any paperwork left behind, that may give names of consignees that you will need to get ahold of. Your attorney may even tell you to file a police report, and/or file an insurance report. Any losses you have regarding the lease, or cost for an attorney, or getting rid of the "junk", could be small potatoes compared to maybe 100 different consignees coming after YOU for their consignment losses.
