Habitual late rent

Tenant moved in 10-2017 has never paid rent on the 1st. Always on the 3rd, except for January 2018 which I filed a 3 day notice. Tenant stats he will pay on the 3rd every month not the 1st for me to "Just get used to it" I have tried politely explain it is due on the 1st, says yes but not late until the 4th. My other 6 tenants understand rent is due on the 1st and pay accordingly except for the rare occasion.

Does your state law say that the rent isn't late until the 4th, or is that language in your lease?
If your lease states that the rent isn't late until the 4th, this means you're allowing a grace period, which your tenant has every right to use.
You can have it both ways. You either want the rent on the 1st, or you want the rent on the 4th. Get rid of the grace period at renewal time if you want it on the first.

I think you are over reacting. And I do agree with the anon below your post. But think about this for a second------If you should ever change your lease to have NO grace period, then the rent is due on the 1st of each month, and late on the 2nd, right? So if you give the T a 3 day notice on the 2nd, that means you have just given him the 2nd, 3rd, and 4th of the month in which to pay the rent. And depending on how your state law reads about the counting of the 3 days, you may not be able to count the day you hand him the 3 day notice. So you may not be able to count the 2nd day of the month as one of those 3 days. If that's true, your T would have till day 5 to give you the rent. Basically, you OWN notices you give to a T, gives them 1-2 MORE days to get the rent to you, than if you just "get used to" getting the rent on the 3rd of each month, as your T said.
