best way to end month to month lease? by Fred on June 15, 2023 @15:28

Our rental property, located in Baltimore County, Maryland, has a tenant with a year 1 year term month to month lease. Through January 2024. She's a good tenant, very clean and pays her rent on time. However, we have small disagreement over a pet dog. And she has decided to claim the puppy as a service dog and as I found out, later that she had intentions on breeding the dog. I see in the online documentation I need to give her 90 days' notice on a month-to-month lease. I have no intention of renting the property in the future and would like to use it for myself as it's located next door to my daughter and grandson.

My question is; should I wait till the end of the lease (Jan 2024) or just to serve her 90 days' notice now?

What would be the fastest way to get her out?

Please restate the end of your first sentence to reflect what you actually have for a lease. You need to read and understand your own lease before asking Qs on the internet.

You are getting the terms " service dog " confused with an ESA---an "Emotional Support Animal" They are not the same thing. Anyone can claim to have almost any kind of an ESA. A "Service dog" MUST be specifically trained to physically assist a person. That training usually costs several thousands of $.

You should NOT use "online docs " unless they are specific to your state LL/T laws. Instead of asking what would be the fastest way to get her out on the internet, you should be asking an attorney about the fastest LEGAL way to get her out.

Hi Fred.

It sounds to me, from clues inferred from your post, that your rental property is likely exempt from FHA laws. See this.

What I’m getting at is that even if her Emotional Support Animal “claim” is legitimate (which it very likely isn’t) then you aren’t required by FHA law to allow it.

Can we assume that the rental agreement prohibits pets, and that she brought the puppy in without authorization? If so, she’s breached the lease and you can terminate the tenancy with a 30-day notice immediately. That would be the fastest way to get her out. See this.
