I have been online all try educating myself on Alabama state laws. Incase you weren't aware Alabama is one of two states that are not specific in the landlord tenant laws. There are specific time periods for notifications, information about turning off utilities and various rental repair landlord responsiblity. Other than that not much else, I did learn I can Evict him for violation of his lease regardless as to what that violation may be as long as I give him 10 days notice. So in one way that helps but it is up to the individual judge(if it has to go to court). As for the utilities, I have no idea, I gave him all the contact numbers the day he signed the lease. Told him it would be easier on him if he had them turned over into his name before I had them turned off so he wouldn't have to be at the house for reconnection. Lease states he is responsible for all utilities and they must be in his name. Even told him I would be disconnecting them on 4/28/06. So who knows with this guy. I don't remember being so out of it when I was 24.

Choose a lawyer familiar with the local court system. Blatent disregard of the lease usually leads to numerous lease violations. My court system looks at how you address lease violations. Ignoring them do not count in my favor, but in the tenant's favor. My lawyer also has stated once it is in eviction, he will be responsible for court costs, etc., should the case be ruled in the landlord's favor. Have you thought about a cure or quit notice, including time frames for him to correct the violations?

If this is your first eviction situation, it is best to go through it with advice from a local lawyer. Is there a sump pump, or anything else on the utilities that can ruin your property? This doesn't sound like a tenant that I would be willing to keep around very long.....
