What does your lease say about changing locks? It is a really bad idea to enter a tenant's unit when he is not there, especially if you are bringing others in too. Even if he is present, it can also be a bad idea. You will not be able to control what the tenant says to the applicants. For the next 60 days, the tenant does not want people in and out of his place when he is not present. The best thing to do is to let the tenant move out, do the cleaning and make repairs before showing.

We have no lease. Its a month to month written agreement. Law dictates that I must give him 24 hours notice before showing to new prospective clients. Law dictattes that he must give me a copy of key. Law dictates that an injunction must be done.

It will be far easier to call him and negotiate a solution. Maybe give the tenant $200 if you sign a lease before he moves. Forcing the issue will only make the matter worse, and could be much more expensive. Regardless of what is legal.

We have no lease. I'm not going to pay him to leave. I am doing this legaly.

I am sorry to say that it does not help that the law is with you. The tenant has already been given 60 days notice. I do not think an eviction can be accomplished in less.

yeah, I would not show apt while tenant is still living there! Tenant could claim his rolex was stolen while you were showing the apt to potential renter and then sue you for hte replacement cost. bad idea

I had a couple I rented to change the locks AND move out a day later than they were supposed to. They were contacted 15 days previous by my attorney that they were to vacate and they STILL didn't leave on time.
They stiffed me for the last month and electricity for 2 months.
