I am from wa state and just finished doing an eviction. First if you have not post a 3 day p&q notice and mail a copy certified (you do not have to do a 20 day notice) assuming this is for non-payment of rent). After that you have to go to court and fill out a bunch of forms (oh how fun that was!). I bought all of the forms I needed with a set of instructions at the court house. It cost about $45 and they called it an eviction kit but you can make copies of them and keep them if you ever need to evict again. Once you have filled out the forms it cost $75 to file. You then take your copy of them and have a process server or someone you know deliver the papers to your tenant (do not deliver them yourself). I went the process server route because I did not want any problems later on with them claiming they didn't get it. If they say they want a hearing that will cost you about $110 more. If they don't request one then you automatically win and go back to court where you file some more papers and pay about $50 more. Then you go to the Sheriff and for another $100 or so they will post a notice to the door and after the deadline they will come back and kick them out. The good thing about it is if they do not request a hearing you can get a Sheriff to post the notice within about 2 weeks or less. Good luck! It was a total pain doing it but well worth it in the long run. I'll keep on eye on this post and if you have any more question just post them. I wish I had had someone to help me through the process when I did it so am glad to help you out if I can.

I really appreiciate this ! I am at the same point you were ~ I have never done this before. Where do I go to at the court house, what dept and is it civil court or superior court? (I am in Tacoma) I will have a process server serve. Did you get an actual judgement against them once this process was done so you could garnish the wages or bank account or do you have to go through another process to get a judgemment ?     I am in King county so I went to the Kent courthouse. If you post your email address I can send you some links that I have. It is in superior court. I did get a judgement but I have not proceeded to try to garnish their wages. I have additional costs since the judgement so my understanding is I will have to go to small claims court to get the total amount due and then I can file to have their wages garnished. The fun just never ends!

Thank you so much for posting the process of Eviction an non-payment tenants. I agree. It is a pain in the.... but well worth it to get rid of tenants that think landlords are getting rich cleaning their mess.

So if I go down and file just my summons and complaint, tenants do not answer, then what do I file next? I am guessing the Writ of Restitution and the unlawful detainer?

really needing to find out what forms there are so i dont waiste precious time i have already served a 3 day p or v and tomorrow is that last day would love to go to start proceeds asap but of course i have not money for the lawyer. WHY paying for this jerk to ride/SQUAT in my rental.... any help would be wonderful i seem to get more and more confused.

The forms cannot be found online for free. There are several websites like rocketlawyer that have the forms for a monthly membership fee. In Pierce County, you can find assistance with forms and questions at the Law Library @930 Tacoma Ave 1st Floor, Tacoma. Their website is www.pclawlibrary.org. You can also contact City of Tacoma Landlord-Tenant Program 253-591-5163 @ 747 Market St Rm 236, Tacoma. Finally, you can contact the Rental Housing Assoc of WA 800-335-2990. Good luck. It really stinks when you trust someone and they take advantage of us and we end up paying money to keep from being sucked dry even more! Frustrating!

i am in the process of evict my tenant. now i have to file the summon and complaint in court. can you please let me know a complete documents need to be file in court?.

1. termination notice.
2. summon and complaint
3. copy of the lease agreement.
4. declaration service agency for service to served temant.
5. motion to order show cause
6. order to show cause.
there are any thing else that i need to complies.?
the tenant also reply to my summon and complaint too.

what if there was no lease made up for a roommate tenant in our house that we own and we have already served them with a notice to pay or vacate? what more can we do if the agreement was verbal and not written up?

Hi Jeanne, I am also in WA state (Snohomish County) and needed to evict my tenants. I've already served the 20 day notice and deadline to move out is today, 3/31/17. Are you able to email me the documents from the Eviction Kit?

I have the Eviction Summons, but nothing beyond that.

Do you know, on the Eviction Summons, what you can state for deadline for response - days? weeks?
