The 1981 Oregon Indoor Clean Air Act (as previously amended in 2001) was amended to ban smoking statewide in all enclosed workplaces in Oregon, including bars and restaurants, as well as within 10 feet (3.0 m) of the entrances, exits, or windows of such places.

McDonald's is a privately owned business. Smoking nearer than 10 feet from the doors or windows in prohibited by state law, even if that doorway opens directly onto a public sidewalk as most do in urban cities.

Great research, however this is not a bar nor is it a resturaunt. Therefore you law may not apply unless I missread it covering privately owned residential property.

    You do know that Colorado has a Smoke Free law? Example;
    Colorado's Clean Indoor Air Act of 2006 requires no-smoking policies in all common areas and 15 feet from the main entryway of any residential apartment building.

    Also here is some of the ways you could have liablity to the tenant for secondhand smoke;

    You stated to show you where in the law does it prohibit anyone from smoking on a public street or sidewalk. I clearly showed you where it does. The sidewalk in front of the restaurant or bar is NOT owned by the establishment. It is a public street/sidewalk. Therefor, if the law states you cannot smoke within 10 feet of the entrance, that 10 feet is part of the public sidewalk.
