Ok, I have to admit, I did post back on Nov 16, and I am not actually being sued(yet), but the earlier post was NOT untrue, and this one is simply geared to finding out: 1. The chances of someone winning such a suit, and 2. The amount they could possibly win.
So I think I have my answer($300-$3000), and that just may be worth it. I'm trimming the tree. Thank you!

The cost to replace the tree depends on the age and size of it. Older, mature trees are not $3,000. Particularly when the tree in question (live oak) can be expected to live hundreds of years. The damages could be closer to $30,000, once you include the cost to remove and replace the tree (digging crew, semi-truck and crane to set that large of tree, diminution of value since you can't buy a similarly-sized tree, etc.). Bottom line: if you trim that tree, and your trimming kills it, you will have a substantial lawsuit on your hands.

You must be rich to have $300 to $3000 to just throw around as a possible debt to you.

i hope you realize that if you cut this tree and damage it in anyway the property owner will not only win a judgment for the value of the tree but also for the amount that such action will devalue their property overall. Healthy trees add considerable value to a property especially a mature, healthy Oak tree. Expect to be hit with a minimum of $10,000 for just property value alone.

Guess you got tired of trying to bed your tenant and decided to go cut down a tree instead.
What an possibly uninformed. Perhaps you'll cut off a vital body part in the process.
