Tenanat had been a few months in the house now he want to move to other house he said he needs bigger house and asked to be transfer the deposit and last month rent. he asked if I have other house bigger for him . I manage a few homes from friends and family. The thing is that it would be from different owners so He is doing breech of contract with the owner , it is not garantie I can rented intermediately and it is not garantie he would leave it clean . What should I answer to him and what shall I do?

You should advise him that he will still be responsible under the original lease until you have a new tenant in the rental, and that his deposit will be settled after you have that new tenant. So, you can explain, he needs to be ready to pay double rent (new place and old place) and a new deposit (new place) if he wants to move (to your other place or any other place).

His other choice is to complete his current lease and then look for a larger place, giving you proper notice of his intended final date.

Tell the tenant that you can not do anything now because the owner of his current lease will not let him out. Be firm in telling him that he will have to stay where he is until the lease expires. What are you going to do when he gets a bigger house and he finds something wrong with that one too?

The fact that he rented a smaller house when he should have rented a bigger house is not your problem.

Comments on security deposit: Doesn't matter whether these are the same or different owners. Two separate transactions because you need to fix-up and/or clean the first house before re-renting it no matter who owns it. So, collect deposit on 2nd house then after they move out of the 1st house do your proper settlement on the 1st house.

Just say no. He has responsibilities under the current lease. When the current lease is up, you can talk then. Don't take on people's problems and whims as your own problem. Learn to say no.

I said to him that if he does beach of contract he stands to loose his deposit and last month rent. That it was better to wait expiration of lease. Also at the moment I do not have bigger homes. Just smell fishy! He didn't answer!
I explain to him he has eviction it will be difficult to get other owner to agree to give him a new contract with eviction and now he wants breach of contract ! His answer: was my aunt has 900 credit score!So I guess he wants his aunt to sign new lease! What a pain!.......
