So I got my tenants moved out. And the damage to the house more than doubles, well almost triples the deposit. They did not leave me a forwarding address even though I asked for it when I pick the key up from them. I have the letter and security deposit statement ready to mail but no where to mail it. I know the wife's Mother's address. Should I just mail it there? Or no?

Send it certified to the property address. Don't send it to the wife's mother.

I just went thru this myself, I sent it to their last known address, certified mail. I was then able to track the letter and received a signed slip back after they signed for it. I also stated that I would give them 10 days (business days) to pay the difference, if not paid I would be seeking legal action. I hope this helps.

Don't get creative with addresses when it comes to the security deposit check. The state statutes specifies 'last known address' so don't violate it by doing what you think is right.

If they give you a forwarding address, use it. If they do not, send it to the last known address and hopefully they have forwarded their mail. I prefer to get the address in writing if at all possible (more documentation for the file).

If the letter is returned to you, do not open it. File it with the rest of the paperwork as proof of the attempt.
