Re: No deposit - Landlord Forum thread 356508

Re: No deposit by Frank (California) on March 20, 2018 @11:05

They couldn't pay a security deposit. So instead of coming up with a security deposit they painted the inside of the house. We paid for the paint and they did the painting. No money was ever exchanged for a security deposit. They were evicted for numerous reasons. They are still living in the house. They claimed that them painting was a security deposit. They say that by painting the inside of the house that that equals the same as one months rent. They wanted to use that "security deposit" as their last months rent.

How are they still in the house if you evicted them?
My definition of eviction is the sheriff will knock on the door, and arrest anyone who refuse to get out. I change the locks at that time. Of course there is a court date and a judge will give an order for the sheriff to do this removal.
Any deposit the T would have been brought up at this court setting.
If they come back they could be arrested if you call the cops. Breaking and entering.

They were given a 60 day notice. The 60 days are not up yet. They wanted to use the supposed "deposit" as the last months rent. I should have stated they were given an eviction notice and that the 60 days were not up yet.

So if they have not paid the rent for say March. You can start the actual EVICTION. You post a 3 day notice on the door as to what amount of rent they owe. After say 5 days you can go to court and file for eviction. Then you go to court the judge will decide on what rent they owe and they will only get a few more days to move. That's when a sheriff would go and vacate the house. The deposit should be withheld until the T moves out so you have some money to repair any damages. But I would say you owe some deposit based on your making this deal from the start.
I would suggest you not rent to someone who lacks the funds to pay rent and deposit prior to getting the keys.
