I moved out of my rental early to give myself an entire month to get the home in order. The landlord showed up to the property days later without notice. (assuming to walk the property after being informed the house would be ready to show to other potential tenants) My lease ends april 30 and on April 2 I was asked to bring my keys and remotes back to the property after being asked to clean a few other items by landlord. I did as asked assuming I would receive my April rent back and days after my rent check was cashed, since then I was told my security deposit would be sent within the week and I no longer have keys to access the property. What do I do ?

All you can do now, is wait for your security deposit to come. Don't expect any of April's rent to get returned, even though in my opinion, you should get 3/4 of it back, because you returned the keys and cleaned a few things as asked, and were out on April 2 or 3. But if you don't get at least your full deposit back by the end of April, you may want to think about taking them to court.

as this is a LL site, we are geared to a forum of colleague LL's,....not discussion and advise to tenants.

however,.....your giving back possession to your LL significantly early was both gracious, generous and nice of you. As a matter of the law, typically monthly rentals are just that. A new month begins at 12:01 AM of the first day of the month, as set by the lease. So with having given proper notice of vacating, unless texas law is different, you owed the rent for the full month.

If your LL actually re-rents the premises before the month runs out,...you would probably have basis for ASKING for an adjustment. Technically, LL's are not supposed to double dip. If you and your LL had a good working relationship AND your LL wants to be a gentleman (woman) they might entertain an ''adjustment''

if you are moved out, why do you want/need the keys?

rent is generally due for the entire month. if you returned possession, whether asked to or nor, that was your decision. You could have said "no" and retained possession until the 30th if you wished.

Don't get April rent back as you needed to be completely out By march 31.
If no damage you should get your deposit back.

Do a bit of checking into your state statutes, but in most cases a landlord cannot collect rent on you and the new tenant...so, if he does rent the unit before the end of your lease, he should refund the difference (usually prorated by the day).

However, the landlord is not obligated to try and rerent your place since you moved our early. Remember, by signing your lease you promised to pay rent through the end of April. So, if he has other units, there is a pretty good chance that he will rent those first.

Your best bet would be to talk to your landlord and ask what his current rental situation is, how likely it may be that someone else might rent it early, and how things looked to him if he did do the walk-through already (in case you can do a better job cleaning for example). Be cordial and nice though.
