Thank you for your responses ! I appreciate all your feedback from everyone on the forum.

I am a live and let live philosophy person but I agree the pattern you are speaking of I am noticing also and have noticed from a previous tenant who was looking for reasons to not pay starts with trying to find a reason not to. I agree not nitpicking everything with a tenant from a previous poster is important however there are boundaries that have been crossed here...and I also wonder what antics they will be up to next.

I will be investigating my states regulations on ending a month to month tenancy... The unit I have is in an area that is in high demand I do not think it would take long to refill it.

Give them thirty days notice, and find a new tenant. If they tear the place up, you can go file a small claims case with the local court. Take pictures and keep the receipts if you have to do repairs, if they tear the place up on the way out. Your local court can give you information on how to correctly give the thirty day notice, it is not hard in my area.
