Tenant makes up issues and not allow me in - Landlord Forum thread 359806

Tenant makes up issues and not allow me in by ownernj on October 13, 2019 @10:34

Tenant reported to Housing department (NJ) on 4 damages without reaching out to me first. Housing filed violation against me, and require me to fix in a period of time, although the rep admitted that damages appeared to be all minors.

In spite of multiple written requests in advance, the tenant doesn't give me the permission to get in for the inspection.

I filed a complain to the court, and have a court date. According to the L-T law in NJ, tenant cann't refuse me to get in for the inspection if I have gone through a right procedure as I did.

The tenant claimed that the reason she doesn't allow me in is because she has fear of me. This is absolutely nonsense. Every single time, if we have to meet (when she hand over cash to us), I have my wife and also her partner present. I rarely talked to her on the phone, only via text messages. So, she has no reasons/evidences to fear.

What should I say or do in the court if she brings up this as the reason? Would judge make the decision just based on her "fear"?

Thanks for your help!

All of this tennant .....I'm in fear of my landlord... Stuff, is nonsense. Frankly I'm starting to think the reason it keeps posting up here is from people trying to get a rise out of the other sincere LLs.

1. Document everything in writing E mail s better than texts
2. Buy yourself a body cam with audio and wear it prominently during any contact with this tenant. First words out of your mouth advises tenant of your recording and if she refuses her permission to record,""stop and immediately leave.
3. Always have your witnesses with you.
4. Post notice of intent to enter as provided in your lease and local laws.
This is your property.
5. Be cautious of retaliatory eviction issues.
6. Photo document repair issues and fix them properly and promptly if they are LL responsibility.
7. if this T is a legitimate crazy (and it's not you or both of you !) decide if you want her gone,....but think carefully abou it and your other options, as it seems that there is one or more motives and back stories here. You're probably going to have a long, expensive court fight,...especially if she's paying below market rent.
8. Stop accepting cash and make sure you have given tenant proper receipts of all cash payments with copies of receipts in your tenant file. Cash is a recipe for he said .....she said, problems.
9. Try to screen more carefully in the future.
