I live in Orange County California and I’m having to have tenants vacate a rental property for minimum 4 months. HOA has court order slope repairs that require units to be vacated. They will be installing pile into the foundation and lifting the units to make them level and stable. Will I be responsible for relocation fees and the additional rent cost as a short term rental will cost from $800-$1500 more than the tenants current rent. They will also have storage cost for the months they are vacated. The tenants still have 25 months left on the lease agreement when construction will start.
Can I terminate the lease in any way?
Do I have to provide an eviction notice or just ask them to be out by the start date?
I don’t want to be a bad landlord. I do want to know my legal rights and be fair. I will take responsibility for what is legal required for me to be responsible for.

First, considering the magnitude of the situation, you really should contact an attorney for assistance.

...but generally, if a property is deemed uninhabitable due to negligence on your part, you are responsible for mitigating damages caused to the tenant. In the short term, that is their housing and storage of property (if their property cannot be left in place).

A solution you may want to consider is to work out a deal with the tenants to break the lease. You may have to put in some money to cover relocation expenses, but that may be better in the long run compared to rent and storage.

contact both a LL/T attorney and a land use / PUD attorney.
this may be covered under your HOA's insurance, your LL insurance and your tenant's renters insurance,....one or all.

sooner rather than later,......you don't want to be heading down the wrong hole.

Ca. and the southern cities have some of the toughest tenant rights laws in the nation,...so act and spend some money appropriately.

depending on your insurance, you may have loss of income coverage which will pay you.
