The T. is supposed to move in this Saturday, lease is signed and money is paid.

This is two-family house, and garage door was damaged by the other existing T. I clearly told the incoming tenant several times that I am not going to fix the garage door until the other T. leaves which should happen in a few months. The incoming T. has accepted it. The existing T. broke the garage door, and he occupied the garage although without my permission, and I would not fix the door and let him to continue to freely use. He is already evicted by the court, after the court reopen, he should be kicked out.

Because of the damaged garage door, people could find a way to get in the hall way of the house, but, inside the house each family has it's own door.

Today, the incoming T. said to me that this poses some security concern.

What should I respond to the incoming tenant?

I really need someone here please advise. Thank you!

In most instances, most LLs (including myself) would say the same as you----we would not fix the door til the current T is gone. HOWEVER, you owe it to your new tenant to have a working garage door, which apparently also provides additional security for the property. Take pics of the damage, then repair/replace the door this week. That will make your new T happy. You will just have to "grit your teeth" if the "evicted" T still gets to use the garage without paying for it, and hope the current T does not cause further damage to anything he has access to.

unless your statements to the new tenant are in writing and accepted ( for example, the new tenant accepts the point that the garage is NOT included until old tenant leaves ) then you are required to repair the garage within a reasonable time. which is less than 30 days during covid and less than 7 days during regular times. But you will be required to refund garage fee to new tenant if it is more than 7 days.

i dont quite understand the access thru garage. isnt there a front door?

You are going to fix the door eventually so why not just do it now and then lock it up so no-one can use it.

if not then board everything up so access is impossible.

Is the hallway inside the house? if so then fix asap.
