Hi,

I have following questions:

1. Is it legal to give 24 hours notice to tenants to access the house for general inspection? I have gave 60 days notice for termination. But tenants says willing to cooperative with moving, but threatening me that landlord not fullfill legal responsibility during his tenancy such that not able to fix electric issue on time etc. I would like to inspect the house, but tenants seems very hesitated to let us access the house. I am suspecting that kitchen might be used by catering service, or tenants whose name not in the lease living there.

What can be a legal reason to access the house? Tenants planned to only allow me to access after he vacant the house. Is it legal to hire someone to station the house to see if anyone who is not in the lease living in the house? And monitor any ab-normal activities happened in the house?

. Another question, according to lease agreement, it is tenant's responsibility to pay garbage. But garbage fee is paid as part of property tax. Is it still ok to charge the garbage fee to tenant? The tenants paid some garbage fee over past years, but not in full. I didn't ask for it, is it still OK to charge him now or deduct from security deposit?


3. I am in California. I charged last month rent and security deposit in original lease which signed many years back. Does tenant have right to sue me for it after he move out?

Adale, you are becoming your own worst enemy. Now that the tenant has received your notice to vacate, and has said he will be out on your time frame, there is NO REASON you need to get inside your rental, until the tenant is OUT! NONE! YES, your T. could make a case for harassment against you, if you continue to want to get in before he moves out, or to try to find out if an unauthorized person is living there. YOU GOT WHAT YOU WANTED, WHICH WAS FOR HIM TO MOVE OUT, SO LEAVE HIM ALONE, AND LET HIM MOVE !!

You should check back in with him on the day he is supposed to be moving, and see how he's doing on his move out, BUT NOT BEFORE that date. REMEMBER, NO MATTER HOW he leaves the place, HE'S OUT!

Once he's gone, go in and take pics of the place, so it's documented on how he left it. Then within 3-4 weeks, decide how much you are going charge him for in unpaid rent, damages, cleaning, etc, and send him your deposit statement to him showing how much you deducted against his deposit. After that, the ball's in his court. He can either accept your statement as to what you have charged him for, or he can try to sue you in court.
