In a Landlord's Shoes™: Burned by The Town of Babylon, NYBy Ms. X (She asked to remain anonymous for fear of the town's retaliation)(LPA Comment: This is very upsetting because this abuse/incompetance is really going on in some towns) I was at the Sanitation Commissioners hearing in Town Hall In Babylon.. I received a 816.47 bill from Town Of Babylon Solid Waste Management.. For Lot Clean-Up. No one could tell me what this bill was for..... After MANY phone calls they said they think it was for an eviction I had on 11/29/07... There was just a few items left in the Apt. The sheriff let us carry down the tenants belongings, because it was just a kitchen chair, a vacuum 2 lamps. a pail and the rest of the stuff fit into a garbage bag.. The Sheriff said they would notify Sanitation.. We called Sanitation and they said they would pick it up with regular schedule pick up because it was such a small amount... there is no charge for regular pick up it is included in our taxes... At the hearing they put up these big pictures of your house and what they picked up...... Well when it came to my house.... They would not look at any of my pictures or paper work... They said I HAD 11/2 TONS OF GARBARGE IT TOOK 3 SANITATION MEN 3/4 OF AN HOUR TO PUT IT IN A REAR LOADER... I SAID THAT IS IMPOSSIBLE. the sheriff would of called the movers if it was that much. MAYBE THEY HAVE THE WRONG HOUSE.... CAN YOU PUT UP THE PICTURE OF MY HOUSE.. THEY SAID THEY HAD NO PICTURES.. PAY THE 816.47 and I can't do anything about it... The unfair thing is there were SO MANY LANDLORDS that did not know they were going to be charged by WASTE MANAGEMENT for pick up of tenants belongings after an eviction... THIS CHARGE THEY ARE TALKING ABOUT IS NOT EXPLAINED ANYWHERE... People that had lawyers do the eviction were charged 2000.00 and were told to sue their lawyer... I did not have a lawyer do the eviction they told me I should of hired a lawyer.. I told them when I purchased the house I went to town hall, I looked up all the Sanitation rules .and I have all the paperwork on accessory apartments. I am very though.. NO WERE DOES IT TELL ANYONE ABOUT THIS CHARGE.. They said "if you're a landlord you should know". IF NO ONE TELLS YOU AND THEY DO NOT HAVE THIS RULE OR LAW WHATEVER THEY CALL IT.. WRITTEN ANYWHERE , HOW WOULD ANYONE KNOW.... NO MATTER WHAT YOUR TITLE IS.... THIS IS UNFAIR AND THE BILLS RANGED FROM A FEW HUNDRED TO A FEW THOUSAND........... I forgot to say these Sanitation Commissioners hearings are held the first Thursday of the month, at Babylon Town Hall 200 East Sunrise Hwy. Town board room.... Also most people got a bill a month after the eviction.. I got a bill 5 MONTHS AFTER THE EVICTION.......WITH THE TOWN HAVING NO PROOF OF WHAT THEY PICKED UP OR EVEN IF IT WAS MY HOUSE.... My house is West XXXXXX - there is a East XXXXXX ...... THEY COULD CARE LESS........ THEY JUST WANT THE MONEY........... Kangaroo court would be an understatement ........ I have no words for what when on today.... And all the Landlords were not RICH..... This amount of money is a real hardship for most of us...... Just don't print my name. I have a feeling this is retaliation.... I will explain I had a tenant that was a little crazy.... She moved at the end of her lease using her security as last months rent... She decided to sue us for 4000.00 . She did not list it on her small claims summons... I can't imagine what we owe her..... BUT HERE IS THE PROBLEM THE LAWYER SHE HIRED WAS THE ARBITRATOR AT SMALL CLAIMS COURT THE DAY WE WERE GOING TO TRIAL.. WE ONLY CAUGHT IT AT THE LAST MINUTE AND ASKED FOR AN ADJOURMENT..... Suffolk county small claims court run a little different then Nassau or the City... Everyone has a trial by the Arbitrator. If they don't agree with the decision then you can ask for a trial de novo..... We hired a lawyer... But here is the problem the average worker in the court cannot have their case heard in this court..... BUT THE LAWYERS CAN.... And We were shocked that day in small claims court everyone we tell cannot believe this... How could he hear the case.... They were ready because my tenant said READY FOR TRIAL... I just wish my husband would of played along and at the beginning of the trial ask for an adjournment but he got nervous and asked right away. Now the arbitrator is saying he adjourned the case....I have been a landlord for 35 years. With a few major problems.... BUT NOTHING LIKE WHAT IS HAPPENING IN THE TOWN OF BABYLON.... I WOULD SAY A LITTLE CORRUPT... So please try and write an article and I WISH I COULD USE MY NAME... I HAVE ALWAYS BEEN FOR JUSTICE BUT IN TODAYS WORLD YOU JUST CANNOT SPEAK OUT.... SITTING IN THAT COURT TODAY I JUST COULD NOT BELIEVE THIS WAS AMERICA... THE LAND OF THE FREE?????????????
