I cannot find one the Iowa Lease (or any other I checked). I've searched the site and haven't found one (not to say that I didn't miss it). I did find a referemce in this thread http://www.thelpa.com/lpa/forum/display?mv_arg=100926 that John was inserting one, but I must be blind.....

If anybody has one to share I would appreciate it.

Here's one that came boilerplate on a form I purchased from an office supply store (very basic):

Quiet Enjoyment. Lessor convenants that on paying the rent and performing the convenants herein contained, Lessee shall peacefully and quietly have, hold and enjoy the demised premises for the agreed term.

look at the house rules clause for Minneosta in the lease see if that covers what you are looking for.

I don't know about Iowa or if it has to be in legal mumbo jumbo. I use standard Realtor Association forms and an addendum which has an extended clause.

Basically I specifies what quiet enjoyment is, and that all tenants have this right and violation is a cause for termination. My rule is any noise heard outside of one's unit is too loud. It is especially too loud if it can be heard inside someone else's unit with the windows closed.

I also have outlawed "sub-woofers" in my multi-families (the thorbbing bass speakers) like smokers if you have to have your boom-boom music you need to live elsewhere.

Here's what I have.


7. RESIDENT PROMISES: 1) Not to act in a loud, boisterous, unruly or thoughtless manner or disturb the rights of the other residents to peace and quiet, or to allow his/her guests to do so; 2) to use the apartment only as a private residence, and not in any way that is illegal or dangerous or which would cause a cancellation, restriction or increase in premium in MANAGEMENT'S insurance; 3) not to use or store on or near the apartment any flammable or explosive substance; 4) not to interfere in the management and operation of the apartment building. 5) that the Apartment, common areas, or area surrounding the building will not be used by the RESIDENT, any member of the RESIDENT'S household, any guest of the RESIDENT, or by anyone acting under his/her control to manufacture, sell, giveaway, barter, deliver, exchange, distribute, possess or use any illegal drugs; or to engage in prostitution or any prostitution related activity; or to unlawfully use or possess any firearm; or to allow any stolen property on the premises.

Isn't "Quiet Enjoyment" a legal right by default to every tenant automatically in all rental agreements?
In my real estate class, we were told it is the law that the landlord must respect the tenant's right to "Quiet Enjoyment", but it does not have to be written.
