Is there a summons and complaint form for Washington state to be used when evicting a non paying tenant on the LPA site? I am new to this and on a month to month from what I understand after the 3 day a 20 days notice needs to be served and then a summons and complaint served? Thank you for your help. G Johnson

I am from wa state and just finished doing an eviction. First if you have not post a 3 day p&q notice and mail a copy certified (you do not have to do a 20 day notice) assuming this is for non-payment of rent). After that you have to go to court and fill out a bunch of forms (oh how fun that was!). I bought all of the forms I needed with a set of instructions at the court house. It cost about $45 and they called it an eviction kit but you can make copies of them and keep them if you ever need to evict again. Once you have filled out the forms it cost $75 to file. You then take your copy of them and have a process server or someone you know deliver the papers to your tenant (do not deliver them yourself). I went the process server route because I did not want any problems later on with them claiming they didn't get it. If they say they want a hearing that will cost you about $110 more. If they don't request one then you automatically win and go back to court where you file some more papers and pay about $50 more. Then you go to the Sheriff and for another $100 or so they will post a notice to the door and after the deadline they will come back and kick them out. The good thing about it is if they do not request a hearing you can get a Sheriff to post the notice within about 2 weeks or less. Good luck! It was a total pain doing it but well worth it in the long run. I'll keep on eye on this post and if you have any more question just post them. I wish I had had someone to help me through the process when I did it so am glad to help you out if I can.

Hi Glorya.

I am currently in the exact same position you were when you needed to vacate. I can't find any assistance to vacate my non-paying renter. My renter is in Snohomish County. Is it possible for you to share the forms you got in your Eviction kit. I am in Spokane County so it is quite a drive to purchase the forms. ANY assistance you can provide me is GREATLY appreciated!

I found the forms by doing search bar Unlawful Detainer Summons for eviction. Came up under State site showing RCW 59.18.365. Form is at bottom of the rule. Same for Sworn Statement Form...RCW 59.18.375
Be sure to print it out big enough, according to rule. One place says can save Service $ by serving both at once, but I think MAYBE have to get a date set for the response form, or maybe just pick a date that has enough time elapsed...not sure yet. MUST wait enough time after serving the 3 day notice, etc. Both forms MUST use same date, if serving together. If serve them separately, it seems o involve an extra "waiting period". Looks to me like just serving the summons might be enough to get them to leave, as not yet officially filed, so it encourages them to NOT yet have it on their record, and may go, just to avoid the possibility of the record. Summons appears to let them know that you're REALLY serious. I'm not exactly sure about exact rules of when to file with court, etc, to get a date set, as haven't digested all the info yet. Hopefully the tenant will leave before that point, so can digest some peaceful sleep.
