Thanks for everyone's input, I do appreciate it. The tenant did ask to be let out of the lease early and I said to put it in writing with the reasons and a date, but they have not done it. When asked about the letter, the tenant said they are waiting ot see if things get better. Well guess what, the complaints are still coming. Should I continue to press them on when I will be receiving the letter since they brought it up???? The tenant is again complaining about smoke, but there is no proof that it is the tenant below. I just don't think anything can make them happy and I believe it is indeed a mental issue. To further complicate things, the tenant works for an attorney and has once sent me a letter saying they believe I am not doing enough (but I have) to resolve the issue. The other day, the tenant again mentioned having discussed the issue with their attorney and wants to keep throwing that in my face. At this point, I am almost welcoming an invite to court so they can maybe talk some sense into the tenant.

By the way, what does "happy clause" mean?

The happy clause is great. It means you say to your tenant "You are not happy living here, so I will let you out of your lease with no penalty if you agree to keep the apartment in spotless condition and be cooperative with showings while I look for a replacement tenant." Then when you get a new renter, you and the current tenant sign a lease termination and be done with it.

      I have a tenant that it seems every month when he pays the rent he is complaining about toilet broken, but we don't know if it was, because he starts taken it apart. He is retired, I think he is lonely, and just wants to see my husband. Today it's the bathroom shower, we still haven't fixed the toilet yet. Last week said we had termites, we didn't. It goes on and on.
      The great thing about him is he keeps the place immaculate, doesn't let any one in with shoes, never late with rent.
      WHAT TO DO !!!

Look, I can SAY that I talked with an attorney about anything. It does not mean that there is anything that a judge would be willing to hear. Next time she trys that you could simply say that you've talked with your attorney, and everything seems fine.

    OMG-I think you have one of my tenant's clones. I recently have had the exact same situation with the smoke smell and her intolerance of the other tenants-complaining about their behaviors. We never know if some of these folks have mental issues even if they look pretty "functional" or are just out-and-out self-centered and entitled. I am a retired schoolteacher turned landlord. Many of these folks are products of the generation whose parents have coddled and did not expect their children to resolve issues on their own.We have to either "train" them or let them go to save your energy and sanity.
