I cannot be the only LL to which this has happened.

Rented property to a handiman for equipment storage.
Long story short, he had turned part of the existing shop into a greenhouse for about 60 cannabis plants. When I found out, I asked him to remove the plants and leave.

He was surprised that it was illegal, since he had a script for it and a copy of the script was displayed inside /he area.

*He had a script printed off the internet without a doctor's signiture.
**He would need to go to the Department of health to get a card.
***There are no cultivation cards/permits issued.
***Cultivation is a Federal offense and the Fed's can seize the landlord's property.

Just an FYI---my lawyer said that at this point in time, it would be smart to not turn a blind eye to cannabis cultivation. The laws will probably change one day, but not today.

It's a federal crime regardless of what states think.

It's basically a "no win" senario for landlords. You're going to get people who say their side is the correct one and regardless of the outcome you're going to lose.

Does your lease have a "no business" can be conducted from the home clause?

Commercial leases indicate what kind of business is being conducted.

Both have no illeagal activities and detail what that means. I thought the details were overkill until Farmer John told me he thought marijuana was legal.

He is of the opinion that he can grow as much as he wants in his rented home, so moved his operation there. My county is not okay with cultivation at all, antwhere. And 60 mature plants can provide enough to smoke 24/7, 365 days a year, so he in far excess of what he needs for personal use. Plus he has six children under the age of ten---there is no way he is keeping them shielded from the plants/harvest/paraphenalia.

As landlords in CO we strictly prohibit growing, smoking, selling, etc. of any illegal substances, including, but not limited to marijuana. We have a no business clause in the lease as well. Some people are under the impression that because MJ is legal here its a free for all. Not the case. There are regulations, (within CO and the county in which property is located) and, as I've pointed out to more than one potential tenant, it's still against federal law. And, due to personal reasons, one of which is job related, we DO NOT want nor permit any such activity on our property. Sorry, but no tenant is worth the risk, it's easier to say NO than deal with the consequences.
