Illegal substance - Landlord Forum thread 344687

Illegal substance by Stephanie (Indiana) on April 27, 2016 @20:49

My fiance and I live in an apartment in fort Wayne indiana. Our new neighbors moved in and have been smoking pot daily..numerous times a day and it is coming through our vents to the point where our entire upstairs smells. We have contacted the office who has done nothing to help the situation. Ive called the police who never end up coming. We have a 3 year old and the bathroom he gets a bath in is where the pot is seeping through. We have another 6 months on our lease but we want out! How would I go about breaking my lease with no financial consequence. This is an unhealthy living environment for our family, especially our son. Please help!!

You need to keep contacting the police on a daily basis. If lower officers don't respond, visit the police head quarters, and contact the Chief of Police personally, if need be. See if they have a drug dog they can bring out. You will not be able to get out of your lease, unless you have absolute proof thru the police dept about the drugs. Then you would need to inform the LL, in writing, giving them the info from the police. Give the LL 30 days to take care of the drug problem or you will give them a 30 day notice you are moving out. Remember, if you decide to break your lease early, and you are taken to court by the LL for doing so, you need all the proof you can get, to show there were illegal drugs there , and the LL did nothing about it.

Do not wait 6 months. Move out now. You might want to get a lawyer now.

If the local police wont respond, try calling the ATF, County Sheriff, or another agency.

Drive to the police station and fill out a report. Multiple times. Then, when you want to leave, ignore the lease.
