I have a unique problem. I have a four unit and I share a dumpster with another four unit by me. Well the city has decided in their wisdom, to provide us with a large trash bin for each of the tenants so that leaves eight large trash bins. We wanted to get rid of the dumpster but the company is charging a ridiculous amount because it wasn't done soon enough so we have a smaller dumpster now. My problem is, when it's filled, my tenants, who have never had to deal with taking the garbage cans out to the street will be required to take them out and bring them back as scheduled by the city. I'm worried because I'm afraid garbage is going to pile up if they don't bring them back and forth to the street as they're supposed to. I am sending them a note to inform them of this at this time and would like to know what you think about a penalty charge if they don't and how much? We are mostly good tenants but I have one I'm worried about. So if you have any thoughts on this or have experienced anything like this and how you dealt with it I would appreciate it thank you in advance.

Do you have a tenant that you could "hire" to be in charge of taking the cans in and out for you? Our gardeners get paid to provide that extra service.

Penalty charge? Why? To make money from a tenant forgetting to bring in the bins.

You're already thinking of a way to punish your tenants (your customers who pay the rent) instead of *working with them to find a way to get this done in a mutually beneficial way to all involved*.

If you still have any leases in effect, a change of terms must be approved by both all parties. Are the trash bins assigned to each tenant or resident? If so, the city would most likely be enforcing any non compliance with the bins being left out. If the city holds the landlord responsible, then you need to have an addendum added to your lease upon renewal or termination. What the city has done, does not change the lease terms, you need the consent of every tenant. I'm sure their will be some getting use to the new bins at first, but coming across with fines might make good tenants into tenants from hell that complain about every little thing. Pick your battles and only those you can easily win.

Take a look at your current lease.

I hope you already have verbiage that says the tenants are responsible to pay any and all fines from the city that were the result of tenants behavior

That is sufficient.

Send the letter. Explain the new city imposed rules. (Emphasized...city imposed rules).

That is all u need, until there is a problem
