Renter refuses to pay rent because no hot water

In NM renting a garage and it does not have living quarters. Renter is living in the storage room now he refuses to pay rent because he says that he needs hot water and will not pay the rent until he gets hot water. What options do I have. Do I have to put a hot water heater? When he rented he knew there was no hot water.

In legal terms, you're screwed. You can not rent out the garage as a living space. It does not have what is required by law. > I knew he was living there You're really screwed. You'll have to tell him that he can not live there as it is not a legal place to live in. Because you have been collecting rent and allowing him to live there, this is a huge mess if he refuses to leave. Lawyer up. This is so funny, when you look at it from my point, Do you have rent control? If yes then reread the info above. If you Dont have rent control then send the tenant a notice that re-states the purpose for which he rented your garage and tell him he cannot live there. and attatch it to a notice 30 days change in terms that re-states the purpose for which he rented your garage and tell him he cannot live there. you might be out of 1 months rent. Since you knew that he was using the space as such, evicting based on this may be a problem until after you serve these notices.

First of all, no you do not need to install a water heater. Your garage is not zoned for living in, and he's not supposed to be living there. Does he get mail at the studio? If so then that establishes residency and you better lawyer up. if not I don't see why you can't act like you just found out about him living there last week, and throw him out! Whatever you do, DON'T act like you knew it and it was OK with you.
