Tenant still in the unit, owes me $350 on September rent, the full amount of October rent, and I am now learning that, due to the incredible amount of evictions in my little town, the summary proceeding will not be scheduled before next month, may be about the 15 of November : may I ask for monetary damages for the unpaid October and November? (prorated)? plus damages.

I have to say that Tenant did not answer the three-day notice served to her September 30th, and she did not pay October's rent at all. Should I send her another three-day notice for October's rent and perhaps a third one in November ?

Charge late fee according to your state where rental property is located .
Handle in person pay or quit letter to the tenant.
Fill out LPA form pay or quit and send to tenant with return receipt.

If she still does not reply, see a landlord tenant attorney and have him to contact tenant.
Do not let the tenant take advantage of you.

Why are you rep early sending 3 day notices?

Each time you do that you are resetting the clock.

On day 4....go file. Do not send another 3 day...get your court date and whatever and whenever...get this tenant out.

The tenant is very happy to have you keep sending these notices because it is extending the time the tenant can live free off of you. GO TO COURT.
