Tenants have broken down car sitting in car port. Tenant is telling me they want to give a 30 day notice to vacate. Due to their living conditions I have reason to believe they will be leaving this car behind upon move out..

What are your opinions on the best way to get them to get this thing out of there? In CA wouldn't I have to store the damn thing for the legal amount of time before trashing it?

3 day cure/quit? Lease addendum? They're on a mtm.. I'm thinking addendum and if it's not gone within a week or so, follow up with a 3 day notice? Wwyd??

Did you not like the advice you were given in the previous thread? What would you be issuing a cure/quit for? What lease provision is in violation?

You cannot unilaterally modify the lease with an addendum. Both parties (you and the tenants) have to agree.

You asked WWYD ?? Well, if you want them out, then encourage them to give you a 30 day notice. If they have not given you one by Dec 15, then you give them one, to be out by Jan.31. Then you need to start reading up on Ca. laws on abandoned items in a rental, including vehicles. Just because you THINK something will be left for you to dispose of, doesn't mean there will be. Why worry about it til it actually happens. Use your "worry" time to educate yourself on Ca. laws, so you know EXACTLY what to do on the first day that they vacate. And the best way to get it out of there-------if they don't want the car, offer them $100 to buy it from them before they move out. As long as they can give you a clean title to it, and you own it, they can leave it there. Then when they are gone, you pay a towing fee to haul it to a scrap yard, and sell it for whatever the scrap price is, thereby getting at lease some of your money back, and no worries of storing it for months.

You didn't say which city in CA your rental is but I know in the city in which I have rentals we cannot have inoperable or unregistered vehicles in our driveways (including car ports visible from the street).

You can call code enforcement and ask them what your ordinances are for these types of vehicles. If your city is the same as mine, I'm sure your code enforcement will happily give your tenants a citation and instructions for removing the vehicle or face heavy fines.

I've never had to remove an abandoned vehicle before but check up on the state's requirements for this, just in case. CA has some peculiar landlord/tenant laws that don't even come close to laws in other states.

Does your lease have a clause about non-operating vehicles being a lease violation.
