Prospective tenant with pet - additional SD ? - Landlord Forum thread 355304

Prospective tenant with pet - additional SD ? by Jason (PA) on December 8, 2017 @13:15

Looking to screen a tenant that has a tea cup Yorkie. I've never had any tenants that have had pets.
Rent is $850 and I would need 1st month + 1 month SD.

Should I require additional SD? And CAN I require additional SD?

Thanks,
Jason

Apparently, you don't know your state's LL/T laws. Look them up, and they should tell you whether, and how much, you can charge for a security deposit. And, yes, you should require an extra deposit if someone has a pet. However, a service animal, or an Emotional Support animal, is not considered a "pet", and you cannot charge extra on the deposit, or more per month, if they have the proper paperwork for those animals. Check the Fair Housing, and ADA laws for the rules on them.

Texas LL here. It is the best idea to charge a non-refundable pet FEE, not a deposit. A fee is by definition non-refundable but a deposit is refundable. By accepting a pet you are taking on additional risk in addition to the tenants.

My SFH pet fee, which is a bit less than the local apartments here charge, is a $350.00 fee for one or two pets up to a maximum of 30 pounds, no aggressive breeds allowed. My current tenants have two cats (I have a cat door to the garage) and they were more than willing to pay the fee.

WA LL. Generally I don't allow pets, but when I have I charged (1) a pet fee at the amount it would cost me to have the unit treated for fleas when the tenant left, (2) I slightly increased the regular deposit to cover any additional damages.

I don't believe in "pet deposits" because they can be viewed as available for only pet caused problems. If there is a question about whether the damage was from the pet or not the tenant may balk at using the pet deposit for a non-pet issue. In the end, I don't care whether it was pet caused or not and I don't want to have to keep track of which deposit to charge; in the end the tenant owes for it.

You should call around to other rental properties in your area and see what they are charging for pets.
