The whole "moral" thing - Landlord Forum thread 272977

The whole "moral" thing by Juan (MS) on December 28, 2012 @00:37

Folks, please lay off the whole "moral" thing, ok???? I only mentioned that because I happen to be a very moral person, and I don't like to cheat other people.

But by the same token, I myself do not like to be cheated, and right now I am being cheated by being force to move after I have paid all my rents on time every time for 2 years!!!!! Wow!!!! Can you folks please show a little sympathy??? Have you ever had to move against your will?? It isn't fun, and its not like I'm some deadbeat - I have been paying my rent.

But this landlady got a crazy hair up her u-know-what, and so now I have to go through the incredible inconvenience of moving. This is unbelieveable.

What I just need from someone is, I need to know how to game the system a little bit, ok? I just need to know how to delay and defer things a bit. I need about another 3 months of time after the eviction goes to court, and I will be paying the landlady during this time(because I'm moral), but I need to know HOW to go about delaying it.

How do I file for an extension? How do I file for a continuance? How do I request a lot more time? If I switch lawyers, does that automatically give me more time? Because if so, I can bounce lawyers around for a little while, that's no problem.

I need to know all the ins and outs. Please, someone who knows....help me a little bit!! Thank you.

You sir, are a selfish prick. It's inconvenient for you to move, yes. It's inconvenient for the landlord to have to go through a process to evict you as well. Someone here is going to be inconvenienced, one legally and one illegally. What do you think is better? To do this the legal way or the illegal way. There is no continuance here. This isn't a dispute because you didn't pay rent or something. The judge won't allow any more time due to how cut and dry this case is. You were given notice to move in a legal manner. Your past rent history and how inconvenient it is for you to move is not even going to be considered here. What will be considered is did the landlord give you notice to vacate within a legal time frame and in accordance win your lease. The answer is easily yes. Your only defense is its an inconvenience to you. Tough doodie!!!! That's not a legal defense. That's a man being a pussy's defense. Man up, take some responsibility and move on.

In your specific situation, there are absolutely no ways at all to delay or contest her legally terminating the rental agreement. She has given proper notice. She has the proof in her hands that she did so.

This is not CSI or a criminal case. You don't switch lawyers to get more time. It won't do anything for you in eviction court. Nothing at all. It case will still go on. There aren't any extensions when you are squatting. And then you will be responsible for ALL court costs the LL has. Also, you will not be able to rent anywhere for a long long time so when the sheriff kicks you out, you will literally be on the street or begging to stay on someone's couch for months.

There are no ins and outs for you. NONE. NADA. After it goes to court, you will have 1 WEEK and then you will be locked out of the apartment by the police.

How do you not understand this? YOU do not own this place. YOU do not dictate the length of your tenancy to your landlord. When YOU own a home and rent it out, you can do that. This is not your place to tell a rightful owner of her property what she can and can't do with it because you don't want to be inconvenienced. How can you not see this????

You're a moral person? Abide by the law. The law says you have to be out without the landlords permission to stay there. As was states earlier, if this is such a huge inconvenience, why did you not rent a place that gave you a lease that was agreeable to you? One that let you stay through your school term? That's just piss poor planning on your part to sign a month to month lease and not have a back up plan. Well... You DO have a backup plan and it's to screw your landlord. Brilliant.

uhhhh, how is this cheating? Being notified properly about moving out isn't being cheated.

If you have money to switch lawyers, offer her more money for rent...maybe lots more money if you have the money to pay attorneys!

AGAIN, you may feel cheated, but you have not been cheated. The landlord has followed all the legal requirements that you yourself are a party to. If you don't want to be moved out for a certain period you should have fought to maintain a termed lease or should buy your own place.

There is no sympathy for you, you have not been cheated. Inconvenienced, maybe, but not cheated. For all you know the landlord's house just burned down and they need a unit to stay in. Who do you think would be more inconvenienced if you try to stretch this out?

There is no way to game the system since the landlord approached the situation in an acceptable manner for all aspects of the law.
